1. Introduction
These Terms of Use govern access to and use of the TrackSyte website, platform, software, APIs, hardware products and related services.

3. Use of the Website
You may use the website for lawful purposes only.
You must not:
- Attempt to gain unauthorised access to systems
- Introduce malicious software
- Interfere with website operation
- Copy or reproduce website content without permission
- Use the website for unlawful activity
4. Platform Access
Access to the Platform is provided to authorised users only.
Customers are responsible for:
- Maintaining account security
- Protecting login credentials
- Managing user permissions
- Ensuring information provided is accurate
TrackSyte may suspend or restrict access where necessary to protect platform security or investigate misuse.
5. Customer Data
Customers retain ownership of their Customer Data.
By using the Platform, Customers grant TrackSyte the right to process Customer Data solely for the purpose of providing services.
TrackSyte does not acquire ownership of Customer Data.
Customers are responsible for ensuring they have the legal authority to upload, connect or process any data provided through the Platform.
6. Monitoring and Telemetry Services
TrackSyte provides monitoring, reporting, alerting and operational visibility services.
TrackSyte does not guarantee:
- Continuous availability of third-party networks
- Cellular coverage
- Satellite coverage
- Third-party hardware availability
- Continuous power availability at monitored assets
Customers remain responsible for operational decisions made using information provided by the Platform.
7. Asset Location Data
Where enabled, TrackSyte may process location information relating to monitored assets.
Location information is provided for operational visibility purposes only.
Customers are responsible for ensuring any use of location information complies with applicable laws and regulations.
8. APIs and Integrations
TrackSyte may provide API access and integration services.
Customers using APIs must:
- Protect API credentials
- Use APIs in accordance with published documentation
- Avoid excessive or abusive usage
- Comply with applicable laws
TrackSyte may apply usage limits or suspend API access where necessary to protect service performance and security.
9. Third-Party Services
TrackSyte may integrate with third-party products and services including, but not limited to:
- Victron Energy
- AJAX Systems
- EFOY Fuel Cells
- MQTT-enabled devices
- Customer-operated systems
TrackSyte is not responsible for the availability, performance or operation of third-party products or services.
10. Hardware Products
Where Hardware is supplied:
- Ownership transfers only upon full payment
- Hardware must be used in accordance with supplied instructions
- Customers remain responsible for installation unless otherwise agreed
- Hardware should not be modified without approval
Hardware warranties are governed by separate warranty documentation.
11. Intellectual Property
All intellectual property rights relating to:
- TrackSyte software
- Hardware designs
- Platform functionality
- Branding
- Documentation
- Website content
remain the property of Green Power Solutions Ltd or its licensors. Nothing within these Terms transfers ownership of intellectual property rights.
12. Availability
TrackSyte aims to provide reliable services but does not guarantee uninterrupted availability.
Scheduled maintenance, upgrades, network failures, force majeure events and third-party outages may affect service availability.
13. Limitation of Liability
To the fullest extent permitted by law, TrackSyte shall not be liable for:
- Indirect losses
- Consequential losses
- Loss of profits
- Loss of revenue
- Loss of contracts
- Loss of business opportunities
- Loss of goodwill
- Loss arising from third-party system failures
TrackSyte's total liability arising from use of the Platform shall not exceed the fees paid by the Customer during the twelve months preceding the claim.
Nothing in these Terms excludes liability for:
- Death or personal injury caused by negligence
- Fraud or fraudulent misrepresentation
- Any liability that cannot legally be excluded
14. Service Changes
TrackSyte may update, improve, modify or discontinue features from time to time.
We will seek to provide reasonable notice where changes materially affect Customers.
15. Suspension and Termination
TrackSyte may suspend or terminate access where:
- These Terms are breached
- Payment obligations are not met
- Platform security is threatened
- Use of the service becomes unlawful
Customers may terminate services in accordance with their contractual agreement.
16. Privacy
Use of the Platform is subject to the TrackSyte Privacy Policy. The Privacy Policy explains how information is collected, processed and protected.
17. Confidentiality
Both parties agree to keep confidential information secure and not disclose it to unauthorised third parties except where required by law.
18. Governing Law
These Terms shall be governed by and interpreted in accordance with the laws of England and Wales.
Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
